1. Acceptance of Terms

These Terms of Use (“Terms”) govern your access to and use of the website operated by Finding Purpose Outdoors Foundation (“FPO,” “we,” “us,” or “our”), a 501(c)(3) nonprofit organization based in Carthage, Texas, at findingpurposeoutdoors.org (the “Site”).

By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Site.

We reserve the right to update or modify these Terms at any time. Changes take effect when posted to this page. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

2. About Finding Purpose Outdoors Foundation

Finding Purpose Outdoors Foundation is a 501(c)(3) nonprofit organization established on July 9, 2025. Our mission is to connect veterans, active-duty service members, Gold Star families, first responders, and medical professionals with guided outdoor experiences that support mental health, community, and purpose.

The Site serves as a resource for information about our programs, events, and opportunities to get involved through volunteering, donating, or sponsoring.

3. Eligibility

The Site is intended for use by individuals who are at least 13 years of age. By using the Site, you represent that you are at least 13 years old. If you are under 18, you may use the Site only with the involvement of a parent or guardian.

Certain features of the Site, including submitting applications and creating participant accounts, require you to be at least 18 years of age.

4. User Accounts

To access certain features of the Site, such as applying for our outdoor programs or registering for events, you may need to create a participant account. When creating an account, you agree to:

  • Provide accurate, current, and complete information during the registration process.
  • Maintain the security of your password and accept all responsibility for activity that occurs under your account.
  • Notify us immediately of any unauthorized use of your account.
  • Not create more than one account per person.

We reserve the right to suspend or terminate accounts that violate these Terms, contain false information, or are used for purposes inconsistent with our mission.

5. Event Applications and Registration

FPO offers guided outdoor experiences for eligible participants. Submitting an application or registering for an event through the Site does not guarantee participation. All applications are subject to review, and event participation is determined through our selection process.

By submitting an application, you acknowledge that:

  • All information you provide is truthful and accurate.
  • You are submitting only one application per event.
  • Selection for events is at the sole discretion of FPO staff.
  • If selected, you will confirm or decline your spot within the timeframe specified in the notification. Failure to confirm may result in your spot being offered to another participant.
  • FPO reserves the right to cancel, reschedule, or modify events at any time for safety, weather, or logistical reasons.

6. Donations

All monetary donations to FPO are processed through Zeffy (zeffy.com), a third-party donation platform. When you click a donation link on our Site, you are redirected to Zeffy’s platform, which is governed by Zeffy’s own terms of service and privacy policy.

FPO does not process, store, or have access to your payment information. Donations are voluntary and generally non-refundable. If you believe a donation was made in error, please contact us and we will work with you on a case-by-case basis.

FPO is recognized as a tax-exempt organization under Section 501(c)(3) of the Internal Revenue Code. Donations may be tax-deductible to the extent permitted by law. Please consult your tax advisor for guidance regarding the deductibility of your contribution.

7. Volunteer and In-Kind Donations

The Site provides forms for individuals who wish to volunteer their time or donate goods and services to support our programs. Submitting a volunteer or in-kind donation form constitutes an expression of interest, not a binding commitment. FPO staff will follow up to discuss availability, logistics, and next steps.

In-kind donations become the property of FPO upon acceptance. FPO reserves the right to accept or decline any offered donation of goods or services.

8. Acceptable Use

When using the Site, you agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable federal, state, or local law.
  • Submit false, misleading, or fraudulent information through any form on the Site.
  • Attempt to gain unauthorized access to any portion of the Site, other user accounts, or systems connected to the Site.
  • Use automated tools, bots, or scripts to access the Site or submit forms.
  • Interfere with or disrupt the operation of the Site or the servers and networks used to make the Site available.
  • Harvest or collect information about other users of the Site.
  • Use the Site in any manner that could damage, disable, overburden, or impair the Site.

We reserve the right to restrict or terminate your access to the Site if we reasonably believe you have violated these Terms.

9. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, images, photographs, and the overall design and layout, is the property of Finding Purpose Outdoors Foundation or its content suppliers and is protected by applicable copyright, trademark, and other intellectual property laws.

You may view and download materials from the Site for personal, non-commercial use only, provided you do not modify the materials or remove any copyright or proprietary notices. Any other use of materials on the Site, including reproduction, modification, distribution, or republication, without the prior written consent of FPO, is strictly prohibited.

10. Third-Party Links and Services

The Site may contain links to third-party websites and services, including but not limited to:

  • Zeffy (zeffy.com) for donation processing, event registration, and merchandise
  • Facebook (Finding Purpose Outdoors Foundation page)
  • Other external resources or partner organizations

These links are provided for your convenience. FPO does not control, endorse, or assume responsibility for the content, privacy policies, or practices of any third-party websites. Accessing a third-party site from our Site is at your own risk, and we encourage you to review the terms and privacy policies of any site you visit.

11. Disclaimers

The Site and all content, materials, and services provided on or through the Site are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

FPO does not warrant that:

  • The Site will be available at all times or operate without interruption or error.
  • Defects will be corrected in a timely manner.
  • The Site or the servers that make it available are free of viruses or other harmful components.
  • The information on the Site is complete, accurate, or up-to-date at all times.

FPO does not provide medical, psychological, legal, or financial advice through the Site. Our outdoor programs are designed to complement, not replace, professional mental health care. Participants should consult with their healthcare providers regarding their individual needs.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Finding Purpose Outdoors Foundation, its board members, officers, volunteers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, or goodwill, arising out of or in connection with your use of or inability to use the Site, even if FPO has been advised of the possibility of such damages.

In no event shall FPO's total liability to you for all claims arising out of or related to the Site exceed one hundred dollars ($100.00).

13. Indemnification

You agree to indemnify, defend, and hold harmless Finding Purpose Outdoors Foundation, its board members, officers, volunteers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney's fees) arising out of or in connection with:

  • Your use of the Site.
  • Your violation of these Terms.
  • Your violation of any applicable law or the rights of a third party.
  • Any information you submit through the Site.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Site shall first be attempted to be resolved through good-faith informal negotiation. If informal resolution is unsuccessful, any legal action or proceeding shall be brought exclusively in the state or federal courts located in Panola County, Texas, and you consent to the personal jurisdiction of such courts.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Finding Purpose Outdoors Foundation regarding your use of the Site. These Terms supersede any prior agreements or understandings, whether written or oral, relating to the subject matter herein.
